How best to navigate the current travel restrictions to Australia for Partner Visa Application

It was in 2003 when SARS virus started its epidemic surge in 26 countries. Luckily, due to obvious symptoms once infected, it was eliminated.

In 2005 another virus, MERS, started its charge into human population. Due to its early aggressive symptoms, it too was removed.

Both CORONA based viruses no longer exists in the world, except in laboratories where they are likely trying to develop a vaccine.

  • These two viruses appeared 15 and 17 years ago. They still haven’t found an effective vaccine for them. Travel Restrictions to Australia were not implemented back then.

Fast forward 2019/2020 a new virus emerged and we were more attuned to it.

So why that brief introduction into the world of ‘viral pain and misery’?

Well, we were preparing ‘what if, scenarios.

One of them were if anyone had their partner visa applicant lockdown in the Philippines, advised to lodge an off-shore Class UF subclass 309. This would lead to a permanent Class BC subclass 100 visa grant.

 Our advice was ‘not to wait for some miraculous vaccine be produced for the COVID-19 virus’ but once the off-shore partner visa was both granted, to apply immediately an exemption to the Travel Restriction into Australia.

  • For those who listened and understood the rational and logic, I assured them it would pay off. We are aware of the travel restrictions would be impose based on Biosecurity Act 2015.

However, we are confident that our off-shore lodgement strategy was the best option to seek a Travel Exemption for partner visa applicants.

That is exactly what has happened.

  • March 11, 2020, we lodged the first off-shore permanent partner visa application.
  • March 26, 2021 their partner visa application to Australia were both granted.
  • We are now applying for the Exemption to Travel Restrictions to entre Australia.
