Historical Background
The Migration Act of 1958 is the legislation governing immigration policy in Australia. The Act has had numerous amendments with the latest major change occurring in 1994. This introduced the concept of a points-based SkillSelect Visa Application System as part of the General Skilled Migration (GSM) program, which was designed to select migrants based on their skills, qualifications, and experience, rather than family or humanitarian grounds.
The General Skilled Migration program allows skilled individuals from outside Australia such as the Philippines to apply for permanent residence based on their abilities, provided they meet certain eligibility criteria. How the Points System is Calculated
The General Points Test is a mechanism used by the Department of Home Affairs to assess and quantify the qualifications of applicants for skilled migration. Points are awarded in the following categories:
- Age:
Points are awarded based on the Filipino applicant’s age at the time of application. Points tend to favour younger applicants who are seen as having more years to contribute to the workforce and pay taxes and levies in turn to the federal, state and local governments.
- English Language Ability:
Filipino SkillSelect visa applicants must demonstrate proficiency in English, with higher points awarded for better language skills. The test results from the designated English test systems are used to assess this.
- Skilled Employment Experience:
Points are awarded based on the number of years a Filipino applicant has worked in their nominated occupation (or a closely related field). More experienced candidates are given higher points.
- Educational Qualifications:
Points are also awarded based on the Filipino applicant’s educational qualifications. Higher-level qualifications, such as a bachelor’s degree or higher, score more points and this is determined using the Country Education Program of the Philippines.
- Australian Study Requirement:
If a Filipino applicants have completed a qualification in Australia (like a degree or diploma) they are also awarded additional points.
- Partner Skills:
If the Filipino applicant’s spouse or partner is also skilled, additional points may be awarded. This encourages the migration of couples where both individuals contribute to the workforce in Australia.
- Designated Language Skills:
Applicants with proficiency in certain languages other than English such at Tagalog, may also be awarded points, especially if those languages are in demand in Australia’s labour market.
- Other Factors:
Points may also be awarded for other factors, such as studying in regional areas of Australia or being sponsored by an Australian state or territory or a relative that lives in a designated area of Australia.
Minimum Points Requirement:
For most Filipino SkillSelect visa applicants, the minimum points required to apply for a skilled migration visa is 65 points. However, some visa subclasses may have different thresholds and points higher than 65 are required.
